How much time do I have to make a claim on my accident or injury?

  • Delaware has a two year statute of limitations and Maryland has a three year statute of limitations.
  • A statute of limitations puts a cap on the amount of time that can pass between the
    time of an incident and the time one has to either settle that claim for file a law suit. If
    you feel you need to bring suit against someone, you need to be aware of any statute of limitations that might affect your claim so that your case is not dismissed from court.
  • What should I do if I am in an accident?

  • You should consider consulting with an attorney at the earliest time possible. Also, remember,
  • do not leave the scene. You are required to provide your name, address, drivers'
    licensed and auto insurance information to the other driver.
  • Call for assistance if required.
  • Avoid any additional collisions by making sure your vehicle and you are not
    presenting a safety hazard to other motorists.
  • Notify the police.
  • Do not admit liability. You should convey the facts of the accident to the police, but it is best not to admit liability at this point.
  • Be sure to obtain the other drivers' information as well as that of any witnesses who
    may be contacted at a later time.
  • Notify your insurance company.
  • Consult with a doctor if you have been injured.
  • Should I release my medical records to the driver's insurance adjuster?

  • No. Medical record releases should only be signed under limited circumstances
    and after consulting with a qualified personal injury lawyer. If your medical
    information gets into the insurance adjuster's hands, it could potentially hurt your case.
  • Maryland Workers' Compensation Claims

    The basic qualification for an injury or medical condition to be covered under the
    Maryland Workers' Compensation Act is that the employee must have sustained either
    an accidental personal injury arising out of and in the course of employment or a
    compensable occupational disease.

    After having established that an injury is covered, there are four basic types of disability benefits. In addition, there are death benefits and medical benefits. Disability benefits can be broken down into temporary total, temporary partial, permanent partial and permanent total disability benefits. The specific types of coverage will be
